Serial rapist Robert Fardon in wait on release ruling

SERIAL rapist Robert John Fardon will wait at least one more month until he discovers whether the court will grant him another chance at life outside of jail.

Fardon was the first prisoner to be handed a indefinite jail sentence in 2003 following his shocking criminal history.

Earlier this year, the Supreme Court granted Fardon's supervised release to live in the Wacol precinct.

But following an appeal by Attorney-General Jarrod Bleijie, the Court of Appeal overruled Fardon's release and ordered his case be re-heard.

The case was listed for a hearing on Monday in the Supreme Court.

But due to the volume of material - including psychiatric reports and an affidavits - submitted to the court, Justice Peter Lyons adjourned the matter until mid-September to review all the information.

Counsel for the Attorney-General, Peter Davis QC, told Justice Lyons the issue in Fardon's case was the 64-year-old had breached supervision orders in the past.

Fardon attempted to merge back into the community in the Wacol precinct in 2006 but was charged with rape in 2008.

Mr Davis cast doubt of Fardon's pledge - detailed in a affidavit - to comply with orders.

"Fardon says he will comply with supervision orders but of course he said that before and he just says it boldly again," he said.

Fardon, a clinical psychiatrist and psychologist are expected to be cross-examined during the hearing starting from September 23.
