Teen jailed over mate's death despite pleas
UPDATE: A TEEN whose best mate fell from the back of his ute and died during a drunken joyride on North Stradbroke Island has been jailed, despite the victim's parents pleading with the judge not to send their son's killer to prison.
Dylan Luke Stubberfield's friend Clancy Shannon died when he was thrown from the back a ute and was run over by the vehicle during a camping trip on Main Beach earlier this year.
Stubberfield, 19, today pleaded guilty in Brisbane District Court to dangerous driving causing death while intoxicated.
The court was told Stubberfield drove a group of friends, who were in the tray of the ute, for about an hour up the beach on March 2, 2018.
He had drunk about eight beers and returned a blood alcohol reading of .129 immediately after the accident.
Stubberfield was today sentenced to four years' jail, suspended after three months' actual custody have been served, despite Mr Shannon's parents Mark and Donna Shannon making impassioned pleas to judge Anthony Rafter to keep the man out of jail.
Mr Shannon even told the court he had made the same decision to ride in the back of a car along the beach at North Stradbroke Island himself.
The court heard Stubberfield visits Mr Shannon's parents often and was employed in their events business.
The court heard friends had warned Stubberfield not to drive on the night of the tragedy.
Barrister Alastair McDougall argued the 19-year-old should not serve any jail time because of his age, the wishes of Mr Shannon's parents of the victim and his level of remorse.
He argued the accident was not a direct result of intoxication and would likely have occurred had Stubberfield not been drunk that night.
Mr McDougall also said teen was not driving on an open road or at a fast speed but Mr Shannon had lost his footing and fallen from the tray when the car swerved to avoid an obstacle.

The courtroom was packed with friends and family of both the teenagers as Mr Shannon's parents both read victim impact statements saying that sending Stubberfield to jail would only increase their pain.
