Drunk driver nabbed in garage

A MAN who recorded more than three times the legal alcohol limit while sitting in his car said he was trying to protect his house from a break-in.

Police went to Robinson Street, Brassall, on January 23 where they found David Andrew Mulcahy sitting in his car in the driveway with the keys in the ignition.

Ipswich Magistrates Court heard police told Mulcahy to get out of the car for a breath test, but he refused, locked the door and drove the car into his garage.

Mulcahy, 36, finally got out of the car and argued with police, saying he could not be arrested for driving on his property. He was breath tested and recorded 0.155.

Mulcahy pleaded guilty to driving under the influence and obstructing police.

He was fined $800 and his licence was suspended for 12 months. The court heard Mulcahy had previous drink-driving convictions in November 2007 and September last year.

Mulcahy told the court he did not comply with the officers because he did not realise he was talking to a police officer.

“I didn’t see a police car at all,” Mulcahy said. He said he was sleeping in his car after drinking alcohol because someone was trying to break into his house.
