Jail for man who filmed himself touching sleeping girl

A MAN who, while high on drugs, filmed himself touching a sleeping seven-year-old girl, will be behind bars for at least 14 months.

The 31-year-old, who cannot be named, pleaded guilty in the Ipswich District Court this week to rape, indecent treatment of a child under 12 in his care, two counts of making child-exploitation material and possessing drug paraphernalia.

The man and his then wife were looking after the girl and her siblings while their parents were away last year.

On two separate occasions when the girl was asleep he filmed himself touching her below the waist.

The two mobile phone videos were later found by his then wife, who was looking for information about an affair he had that ended their marriage.

She found the two videos and recognised his hand from a scar on it. She initially thought the girl was their own daughter and took the children out of the house.

The girl had no memory of the event.

The court heard the man was ashamed of his actions, told his wife he had been under the influence of drugs and wrote a letter to her explaining his remorse.

He had repeatedly tried to delete the videos from his phone, but the court heard they "kept coming back" when the app was updated.

Justice Greg Koppenol said while he was convinced the man wasn't a pedophile, his actions had been pedophilic.

He was sentenced to three and a half years jail, with a parole eligibility in 14 months.
