Fate of man accused of murder in hands of jury

THE future of a young man accused of killing his step-grandfather is now in the hands of a jury since the prosecution and defence closed their cases after a trial in the Bundaberg Supreme Court.

Mr Cummings questioned why Lovell would take the almost 1000km round trip from Toowoomba to Burnett Heads with his mother if he didn't want to be involved in the murder as he claimed.

"If she is the driving monster as perhaps portrayed ... why was the accused there? What was his function? Why did he go there?" Mr Cummings asked.

"He was there because he wanted to make $50,000 and $50,000 was a fair cop to kill grandad."

Mr Cummings said Lovell's involvement was crucial.

"She (Brownlow) didn't have the guts and she didn't have the physical prowess (to murder Mr Behrendorff) - that was his job, bought and paid for," Mr Cummings said, pointing to Lovell.

"Here you have someone who is physically powerful and capable of dispatching Robin Behrendorff - that's the only reason he was there."

But defence barrister Robert East said his client had only agreed to help his mother smother Behrendorff in his sleep, but that plan fell through when the man woke up during their break-in, causing them to panic.

Mr East said his client became involved in a struggle with Behrendorff, who spotted him in his house.

"What followed was a panicked retreat," Mr East said.

"This poor, and it must be said, stupid young lad was involved in this out of some misguided loyalty to his mother."

The jury deliberates today.
