Service station armed robbers sent to jail

TWO men who robbed a Toowoomba service station in March this year have been sentenced to jail.

Tony Shires and Kyle James Frost pleaded guilty in the Toowoomba District Court yesterday to four charges including armed robbery and stealing.

Shires pleaded guilty to an additional charge of armed robbery relating to a March 9 incident when he robbed a service station while armed with a knife and made off with about $200.

The court heard Shires covered his face and armed himself with an axe when he stormed Freedom Fuels in Toowoomba on March 15, making off with about $300 in cash while making demands for more.

Shires then targeted the United Petroleum Toowoomba Range on March 16.

Judge Michael Shanahan noted Frost's involvement in the March 15 and 16 robberies was to act as the getaway driver, and therefore his offending was at the lower end of the scale.

He took into account the fact Shires and Frost had both been drug addicts at the time of the offending, but the time the pair had spent in custody since being arrested on March 17 this year had allowed them to shake the addiction.

Mr Shanahan said both Shires, 23, and Frost, 21, had criminal history but had not spent time in jail.

But in determining his sentence, Mr Shanahan said he must impose a penalty that would deter others from targeting corner shops and service stations and the workers at such businesses.

Shires was sentenced to four years jail with a parole date of March 16 next year.

Frost was sentenced to two and half years jail with immediate parole yesterday.

Mr Shanahan said Frost and Shires had both served more than 240 days in pre-sentence custody.
