Drunken clubber gets hit with $400 fine for assault

A REDBANK teenager found himself in trouble with the law after a night out turned violent.

At Ipswich Magistrates Court this week, Dale John Magus pleaded guilty to one charge of common assault.

The 19-year-old was out clubbing when he punched an employee of a Brisbane nightspot in the head - and apparently took pride in it.

Police prosecutor Senior Sergeant Ian Taylor said Magus knew the staff member and had accused him of spreading rumours.

The employee, Daniel Wells, was on a break and walking down Brunswick St, when he was confronted by Magus about 3.30am on August 17.

Magus swung three punches at Mr Wells but only one connected. It hit Mr Wells in the left-side of his head and caused swelling.

Mr Wells pushed Magus away and returned to work at The Beat Megaclub. Magus also returned to the club and appeared to be gloating about the incident.

The victim later reported the assault to police.

Defence lawyer Claire Greer-Wilson said Magus was drunk at the time of the offence and was "extremely remorseful".

"It wasn't until he woke up that morning that he realised he had done something wrong," she said.

Ms Greer-Wilson said her client had no criminal history and had apologised to Mr Wells.

Magistrate Barry Cosgrove said drunkenness was never an excuse or defence for violent behaviour. Magus was fined $400. No convictions were recorded.
