Drug trafficker loses appeal, claimed lawyers misled him

A FORMER Gympie man convicted of trafficking meth has lost his bid to change his jail sentence after claiming his previous lawyers had tricked him.

A judgment handed down on Friday from the Queensland Court of Appeal ruled that Craig Cant's eight-year jail sentence for trafficking meth was not excessive and refused his appeal.

Last year, Cant was sentenced to a total eight years jail after pleading guilty to 12 offences; the most serious was trafficking meth for about a year between 2011 and 2012.

During his sentencing hearing, Cant, now 56, spoke up and told the court at the time that he did not agree with all the facts.

After speaking to his lawyer during a brief adjournment, his lawyer returned and told the justice that Cant was ready to be sentenced.

But Cant claimed his lawyers had misled him and that they told him to say nothing and that he could fix the errors later.

"(Mr Cant's) contention is that he was tricked into being sentenced on incorrect facts…" Justice David Jackson said in Friday's judgment.

Justice Jackson said Cant had signed paperwork saying he had been taken through the summary of allegations made against him and understood that pleading guilty meant he accepted the allegations.

Cant's former lawyers also denied Cant's claims they had misled their former client and Justice Jackson said there was no reason to reject their evidence.

Cant also claimed the sentence he received for trafficking drugs was excessive but Justice Jackson dismissed this, saying the sentencing justice had taken relevant factors into account at the time. - ARM NEWSDESK
