Assault victim speaks about violent night in Brisbane

A HERVEY Bay man who, along with his brother-in-law, was violently assaulted after having a meal at a Brisbane pub says he was "just in the wrong place at the wrong time".

Graham Law, 64, had travelled to Brisbane with Terry White, 73, ahead of treatment at the Royal Brisbane and Women's Hospital after being diagnosed with bone cancer.

The two checked into their accommodation and then decided to have a meal in the beer garden of the Victory Hotel.

Mr Law said a man approached them and said: "You're a bit old to be here."

Mr Law replied: "I don't think so, mate," and left to have his meal.

The assault began as the two left the hotel after finishing their meal, Mr Law said.

He said he had copped a punch to the back of his head.

When he fell to the footpath, the man started kicking him in the shoulder and around the head.

The man also assaulted Mr White, leaving him with broken ribs.

Mr Law has been left with a fractured cheekbone, soreness around his head and shoulders and stitches.

"There's a fair bit of pain," Mr Law said.

After spending some time in hospital in Brisbane, the men are now home in Hervey Bay, making a steady recovery.

A man, 32, has appeared in Brisbane Magistrates Court facing charges over the incident and has been denied bail.
