Man chokes daughter over loud TV

A LOWOOD father choked his daughter because she was watching a movie with the volume up too loud, a court was told.

Ipswich Magistrates Court was told the 29-year-old was woken on November 15 by two of his daughters watching Twilight.

The man told the 10-year-old and 11-year-old to take the dog for a walk but when the girls returned he attacked them.

Prosecutor Sergeant Mark Muller said the father-of-five grabbed his 11-year-old daughter by the neck and choked her until she could not breathe.

He then punched the girl to the chest and hit her legs – the 11-year-old suffered bruising to her neck, chest and legs

The man grabbed his 10-year-old daughter on the wrist and shook her violently before throwing her onto a mattress and hitting her legs.

The girls told their mother about the attack and the police were called. On the way to the police station, Sgt Muller said the man had scratched his name in the police vehicle.

The father pleaded guilty to assault occasioning bodily harm, common assault and wilful damage. He also admitted entering a stranger’s house with his de facto on June 14 in Kingaroy to steal property.

The November offences were committed while the man was on a suspended sentence for common assault and entering a premises.

Defence lawyer Erin Beer said the assault began as domestic discipline after the children refused to do as they were told.

“My client then told them to clean up their room but he was receiving cheek and unfortunately the following events occurred,” she said.

“He never intended to hurt his children ... When this occurred he lost his temper.”

Ms Beer said the man damaged the police vehicle because he was angry about being arrested and did not think police were listening to him.

Magistrate Virginia Sturgess told the man he had to be the adult in the family and not lose his temper.

“Being a parent carries enormous responsibility,” she said. “At the end of the day somebody has got to be the grown up and that’s you.”

The man was sentenced to six months and two months jail for the assaults and three months for entering the home. His suspended sentence was activated and he was ordered to serve three months.

He will be released on parole on Christmas Eve.
