Bleijie fights Supreme Court order to release sex offender

UPDATE: ATTORNEY-GENERAL Jarrod Bleijie will apply for an immediate stay of the order to release Robert John Fardon.

Mr Bleijie has also instructed Crown Law to appeal the decision made by the Supreme Court to release him.

 

Serial sex offender to be released from jail

Bravehearts founder Hetty Johnston has slammed a decision to release a repeat sex offender, predicting he will breach his supervisor order or reoffend within 12 months.

Ms Johnston said she was "just appalled" Robert John Fardon would be in the community from Thursday.

"We've come to expect no different though," she said of the decision.

"Thank goodness for the Royal Commission into child sexual assault.

"I hope they look at decisions like this and put them on the dinosaur bucket where they belong and start to put the civil rights and human rights of children and families before  those of convicted repeat child sex offenders."

Ms Johnston said two psychiatrists had found Fardon was still a danger but a psychologist found he had changed.

"We've had people assess him, people who are supposed to know what they're doing, and two of the three say he's a psychopath," she said.

"Two of the three say he's dangerous.

"Two of the three basically say don't release him.

"This is why the Queensland Government has introduced the two strikes and you're out policy so when this happens again then they'll be in for life and take away the court's opportunity to trash the human and civil rights of the general community."

 

EARLIER: Serial sex offender Robert John Fardon will be released from jail at 4pm on Thursday despite a judge finding he was still a "serious danger to the community".

Justice Debra Mullins said, in written judgment handed down on Wednesday, that risk could be managed with a strict supervision order for Fardon, who had been jailed indefinitely.

She said adequate protection of the community from the risk of violent sexual offending was not a "precise measurement or prediction".

"The act does not contemplate that arrangements under a supervision order to prevent the risk of reoffending must be watertight," she said.

Fardon, a 64-year-old psychopath born in northern NSW, will be released into the Wacol precinct with a five-year supervision order.

Fardon cannot have any direct or indirect contact with his previous victims.

He is also banned from going unsupervised to a place that houses children, intellectually disabled persons, mentally ill persons or people with substance misuse difficulties.

Fardon must continue treatment from psychiatrists and psychologists as directed.

He must comply with curfew and monitoring directions, hand over phone and computer password so Corrective Services can randomly examine them, and must abstain from drugs and alcohol.

Fardon, who was born in Murwillumbah, committed his first sexual offence at age 18 in northern NSW - appearing in the Murwillumbah and Grafton courts for attempting carnally to know a 10-year-old girl.

Fardon - the first sex offender jailed indefinitely under Queensland laws - has spent almost 23 years in prison since October, 1980.

The three most serious crimes relate to sexual offences, two involving children.

Fardon told Brisbane Supreme Court during a hearing last week that he had prepared a plan to deal with his tendencies in the community.

"At the point of impact, when it occurs I would remove myself from that location and wait until I can discuss it with (my psychologist)," he said.

When asked why he had not participated in a recent transition program, Fardon said it was all theory and he needed practical applications such as opening a bank account, how to use an ATM and how to use a Go Card on public transport.
